  75. So that Search Express and its files can set up correctly, you must run
  76. INSTALL.EXE.
  77.  
  78. To Install Search Express
  79. 1. Place the Search Express diskette in drive B.
  80. 2. From the Program Manager, click File and select Run.
  81. 3. In the run dialog box, type b:Install.
  82. 4. Click OK. The Install program will be loaded.
  83. 5. Install suggests that SearchExpress be installed in dir C:\EXPRESS.
  84.  
  85. You can accept this by clicking OK or change it to a directory you
  86. prefer. You can also do a custom installation. If you choose this option
  87. you can install the InfoRecall program files only, without the sample
  88. files or the sample files only, without the program files.
  89.  
  90. Install will now install all the necessary files to the directory you
  91. have chosen and while doing so, will show you its progress to completion.
  92.  
  93. 6. When all the files have been copied into your directory, Install will
  94. ask you if it should add Search Express to the Program Manager.

  211. foregoing, without the prior written consent of Phantech Software Inc.

  217. You may make back-up copies of the software but not of the user

  220. drive is permitted subject to these conditions.

  222. COPYRIGHT
  223. Phantech Software Inc. owns all intellectual property rights in the
  224. software and the user documentation.  Theserights are protected by
  225. Canadian and United States copyright laws, other applicable copyright
  226. laws, and international treaty provisions.  Phantech Software Inc.
  227. retains all rights in the software and user documentation not expressly
  228. granted under this Agreement.

  230. TERM
  231. This license is effective until terminated in accordance with this
  232. Agreement. You may terminate it at any time by destroying the software
  233. and user documentation together with all copies, modifications and merged
  234. portions in any form. Your license will also terminate upon conditions
  235. set forth elsewhere in this Agreement or if you fail to comply with any
  236. term or condition of this Agreement.  You agree that upon such
  237. termination you will destroy the software and the user documentation
  238. together with all copies, modifications and merged portions in any form.
  239.  
  240. LIMITED WARRANTY
  241. Phantech Software Inc. warrants the supplied diskettes to be free from
  242. defects in materials and workmanship under normal use for a period of
  243. ninety (90) days from the date of delivery to you as evidenced by a copy
  244. of your receipt. The software and user documentation is provided "as is"
  245. without warranty of any kind, either express or implied, statutory or
  246. otherwise, including but not limited to any implied warranties of
  247. merchantability and fitness for a particular purpose. The entire risk as
  248. to the quality and performance of the software is with you.  Should the
  249. software prove defective, you (and not Phantech Software Inc.
  250. or its authorized dealer) assume the entire cost and responsibility for
  251. all necessary servicing, repair or correction.  For greater certainty,
  252. Phantech Software Inc. does not warrant that the functions contained in
  253. the software will meet your requirements or that the operation of the
  254. software will be uninterrupted or error free.  The warranty and remedies
  255. set forth herein are exclusive and in lieu of all others, oral or
  256. written, express or implied. No authorized dealer, distributor, agent or
  257. employee of Phantech Software Inc. is authorized to make any
  258. modification, or addition to this warranty.  Some states do not allow the
  259. exclusion of implied warranties, so the above exclusion may not apply to

  263. LIMITATIONS OF REMEDIES
  264. Because software is inherently complex and may not be completely free of
  265. errors, you are advised to verity your work and to make back-up copies.
  266. The liability of Phantech Software Inc. and your exclusive remedy shall
  267. be (a) the replacement of any diskettes not meeting the limited warranty
  268. provided above, so long as the diskettes are returned to Phantech
  269. Software Inc. or its authorized dealer  with a copy of your receipt
  270. within ninety(90) days of purchase;  or(b) if we are or the dealer is
  271. unable to deliver a replacement diskette(s) which is free of defects in
  272. materials or workmanship, you may terminate this Agreement by returning
  273. the software and all user documentation to us or the dealer.

  275. IN NO EVENT WILL PHANTECH SOFTWARE INC. BE LIABLE TO YOU FOR ANY
  276. DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR
  277. CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE
  278. SOFTWARE EVEN IF PHANTECH SOFTWARE INC. OR ITS AUTHORIZED DEALER HAS
